1. About These Terms
These Terms and Conditions ("Terms") govern your use of the Gourmet2Go website and your purchase of meals and subscription services from Gourmet 2 Go Pty Ltd (ABN 83 676 180 055) ("we", "us", "our"), a meal delivery business based in Melbourne, Victoria, Australia.
By placing an order or creating an account, you agree to be bound by these Terms. Please read them carefully before using our services.
2. Orders
Orders must be placed by the weekly cutoff deadline displayed on our website. Orders placed after the cutoff will be processed in the following week's delivery cycle.
All orders are subject to availability. We reserve the right to substitute a meal of equal or greater value if a selected item becomes unavailable, and will notify you prior to delivery.
Prices are displayed in Australian Dollars (AUD) and are inclusive of GST. We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
3. Payment
Payment is processed securely via Stripe at the time of order. We accept major credit and debit cards.
For subscription plans, your nominated payment method will be charged automatically on a weekly basis until you cancel. You will receive a receipt by email for each charge.
If a payment fails, we will attempt to notify you and retry the charge. Unresolved payment failures may result in suspension of your account.
4. Delivery
We currently deliver to selected suburbs across Melbourne, Victoria. Delivery zones are listed on our website and may be updated from time to time.
Delivery is made on the scheduled delivery day for your area. Someone must be available to receive your order, or a safe drop location must be nominated. We are not responsible for meals left unattended for extended periods after delivery.
We take reasonable care to ensure deliveries arrive fresh and on time, but cannot guarantee delivery times due to traffic and other factors outside our control.
5. Food Quality, Allergens & Dietary Requirements
All meals are freshly prepared by our kitchen team from fresh, whole ingredients, with no added artificial preservatives. Meals are never frozen.
Our meals are made in a shared kitchen that handles a wide range of ingredients and allergens, including (but not limited to) gluten, wheat, dairy, eggs, peanuts, tree nuts, sesame, soy, fish and shellfish. Because of this, any meal may contain, or may have come into contact with, any of these allergens. We cannot guarantee that any meal is free from a particular allergen, and we do not operate an allergen-free kitchen.
For this reason, we do not describe our meals as suitable for any specific diet (for example "gluten-free", "dairy-free", "vegan" or "vegetarian"). Where we list the ingredients or the allergens a meal "contains", this is provided for general information only and is not a guarantee of suitability.
We are unable to accommodate individual dietary requests, ingredient substitutions or modifications. Meals are prepared to a set recipe and supplied as described.
If you have a food allergy, intolerance or specific dietary requirement, our meals may not be suitable for you and you order at your own discretion. It is your responsibility to review the information provided and decide whether a meal is appropriate for you. If you have a severe or life-threatening allergy, we strongly recommend that you do not rely on our meals.
Meals should be refrigerated upon delivery and consumed within the use-by date indicated on the packaging.
6. Subscriptions
Gourmet2Go offers weekly subscription plans that provide regular meal deliveries at a discounted rate.
You may pause or cancel your subscription at any time before the weekly cutoff deadline. Cancellations after the cutoff will take effect from the following week, and the current week's order will proceed and be charged.
Subscription discounts apply only while the subscription is active. Pausing a subscription for more than 8 consecutive weeks may result in the subscription being cancelled.
7. Cancellations & Refunds
You may cancel an individual order before the weekly cutoff deadline for a full refund.
If your order arrives damaged, incorrect, or of unsatisfactory quality, please contact us within 24 hours of delivery with details and photos. We will offer a replacement, credit, or refund at our discretion.
We do not offer refunds for change of mind after the cutoff deadline has passed.

8. Your Account
You are responsible for maintaining the confidentiality of your account credentials. Please notify us immediately if you suspect unauthorised access to your account.
You must provide accurate and current information when creating your account. We reserve the right to suspend or terminate accounts that provide false information or breach these Terms.
9. Privacy
We collect and use your personal information in accordance with Australian privacy law. We use your information to process orders, send delivery updates, and where you've opted in, to send marketing communications.

10. Limitation of Liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. For services, you are entitled, for a major failure, to cancel and obtain a refund for any unused portion or to compensation, and to have problems rectified within a reasonable time for a failure that is not major.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL that cannot lawfully be excluded.
To the maximum extent permitted by law, and subject to the consumer guarantees above, we are not liable for any indirect, incidental or consequential loss arising from your use of our services. Where our liability for failing to comply with a consumer guarantee can lawfully be limited, that liability is limited, at our option, to resupplying the goods or services or paying the cost of having them resupplied.
11. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page with a "Last updated" date. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of Gourmet2Go services will be subject to the exclusive jurisdiction of the courts of Victoria.
